Global website terms and the baseline B2B commercial framework.
These Terms govern your use of the Archai website at www.archai.co.kr. The website gives general information about Archai's business-to-business products and lets you contact us; it does not sell anything online, and any purchase is made only under a separate written contract.
The website at https://www.archai.co.kr and its subpages (the "Website") is operated by Archai Electronics Inc. (주식회사 아카이전자), a company incorporated in the Republic of Korea ("Archai", "we", "us"). Our company details are set out in the Archai Korea Legal Disclosure.
The Website also contains information about other Archai group companies, such as our UK company ARCHAI POWERTECH LTD (see the Archai UK Legal Disclosure) and our manufacturing affiliate in Kunshan, Jiangsu, China, Yoono Energy Technology (Jiangsu) Co., Ltd. Unless stated otherwise, these Terms are concluded with Archai Electronics Inc.
The Website is intended for business visitors such as utilities, OEMs, EPC contractors and other professional users.
By accessing or using the Website you agree to these Terms. If you do not agree, please do not use the Website. Where we state additional terms for a particular area or download, those terms also apply and, if they conflict with these Terms, prevail for that area or download.
You may browse the Website and download or print its content for your own information and for evaluating Archai products and services within your organisation, subject to these Terms and to the Intellectual Property & Open Source page.
You must not:
If you believe you have found a security vulnerability, please report it to postmaster@archai.co.kr and do not test it further.
The Website and its content — including texts, graphics, photographs, product images, documents, interactive demonstrations and software — are owned by or licensed to Archai and are protected by copyright, trademark and other intellectual property laws. Apart from the limited use permitted in section 3, no right or licence is granted to you.
Archai® and the product names marked ™ on the Website are trademarks of Archai Electronics Inc. Details, and the open-source components used by the Website with their licences, are on the Intellectual Property & Open Source page.
Content on the Website is provided for general information only. In particular:
Nothing on the Website is an offer to sell, a quotation or a binding commitment, or a warranty, guarantee or assurance of any product characteristic. Contracts are formed only as described in section 11.
To the extent permitted by applicable law, the Website and its content are provided "as is" and "as available", without warranties or representations of any kind, express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose or non-infringement. We do not warrant that the Website will be available without interruption or free of errors or harmful components, and we may change, suspend or discontinue the Website or any part of it at any time.
To the extent permitted by applicable law, Archai is not liable for any loss or damage arising out of or in connection with the use of, or inability to use, the Website, or reliance on its content — including indirect or consequential loss and loss of profit, revenue, business opportunity, goodwill or data.
Nothing in these Terms excludes or limits liability:
Liability in connection with Archai products and services is governed exclusively by the contract under which they are supplied.
The Website may link to websites of third parties, such as standards bodies, certification bodies or partners. These links are provided for convenience only. We do not control those websites and are not responsible for them, and a link does not mean that we endorse a website or its content.
Please do not send confidential information, trade secrets or export-controlled technical data through the contact form or by unsolicited e-mail. If confidential information needs to be exchanged, contact us first so that a non-disclosure agreement can be put in place.
Sending an inquiry does not create a contract, an obligation for us to respond in a particular way, or any duty of confidentiality beyond what applicable law and our privacy policies provide. Personal data you provide is processed as described in section 12.
Products, software, technology and technical information described on the Website — including products with cryptographic security functions — may be subject to the export-control and sanctions laws of the Republic of Korea, the United Kingdom, the European Union, the United States and other countries. Access to information on the Website does not authorise any export, re-export or transfer. You are responsible for complying with the export-control and sanctions laws that apply to you. Our approach is described in the Export Control & Sanctions Policy.
Archai supplies its products and services to business customers only. This section explains, as a matter of principle, how commercial dealings with Archai are formed. It does not itself create contractual obligations and is not a set of standard terms of sale.
Archai processes personal data in connection with the Website as described in the Global Privacy Policy. Additional information applies to visitors in Korea in the Korean privacy policy (개인정보 처리방침) and to visitors in the United Kingdom and the European Union in the UK / EU GDPR Addendum & Cookie Policy.
We may amend these Terms, for example to reflect changes to the Website, to our business or to the law. The current version is published on this page with its version number and effective date and applies to your use of the Website from that date. We announce material changes on this page at least 7 days before they take effect.
These Terms, and any dispute arising out of or in connection with them or the Website, are governed by the laws of the Republic of Korea. The Seoul Central District Court has exclusive jurisdiction at first instance; either party may nevertheless apply to any competent court for interim or injunctive relief.
If you use the Website as a consumer, this choice of law and court does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside, and you may also bring proceedings in the courts that have jurisdiction under that law.
